How Netz handles personal information — the information you give us, the information merchants store on our platform, and the difference between the two.

Introduction

This policy explains what Netz Intelligence Inc. does with personal information — what we collect, why we hold it, who we give it to, how long we keep it, and what you can require of us.

It covers our websites at netz.com and netz.ai, and the Netz platform. It describes our handling of information, not the features of our product.


The most important thing to understand: our two roles

Almost every question about privacy on a commerce platform turns on a single distinction, so we put it first.

When we decide what to collect and why — a demo request on our website, an account we open for a merchant, our own service email — we are the controller of that information, and this policy governs it directly.

When a merchant uses Netz to run their business, the information about their customers belongs to them. They decide what to collect, why, and for how long. We store and process it on their instructions, and we are the processor. In that situation the merchant’s own privacy policy governs, not this one.


Limits we place on ourselves

The rest of this policy is written to be consistent with the following. Each is a limit on what we may do with personal information.

  • We do not sell personal information, and we do not rent or trade it.
  • We do not use one merchant’s data for another merchant’s benefit. Accounts are isolated from each other.
  • We do not build marketing lists of our own out of the records merchants store on the platform.
  • We collect what providing the service requires, and we state what that is rather than reserving broad rights we do not exercise.
  • When a merchant instructs us to delete something, we delete it, on the schedule set out below.

What we collect, and why

We group this by where the information comes from, because that is what determines how we may use it.

From visitors to our website

About a merchant’s own customers

A merchant’s Netz account may contain names, contact details, addresses, order history, subscription records, support conversations, and email or SMS engagement data about their customers.

We process all of it as a processor, on that merchant’s instructions and for no independent purpose of our own. We use it to provide the service on their instruction, to keep it secure, and to comply with the law.


Messages we send you

If you hold a Netz account we send you service messages — account confirmations, password resets, security and billing notices, and reports you have configured. They are necessary to operate the service, they are not marketing, and you cannot opt out of them while you hold an account.

If you asked us to contact you about Netz, for example by requesting a demo, we use the details you gave us for that purpose. You can tell us to stop at any time by replying or by writing to [email protected].

Messages you receive from a brand that uses Netz are not sent by us. That brand decides who it contacts and on what basis, and it is the controller of the contact details involved. We deliver those messages on its instruction, and its privacy policy governs them.


Who we share information with

We do not sell personal information, and we do not share it for anyone else’s independent marketing. We share it in four situations.

  • Service providers who help us run Netz — hosting and infrastructure, database hosting, email and SMS delivery, payment processing, error monitoring and support tooling. Each is bound by contract to use the data only to provide their service to us.
  • On a merchant’s instruction — for example when they connect an integration, export their data, or ask us to send it somewhere.
  • Where the law requires it, or to establish or defend legal claims, or to protect the rights and safety of people using the service.
  • In connection with a merger, acquisition or sale of assets, in which case we will tell affected users and this policy continues to apply until it is replaced.

Where your information goes

Netz is operated from the United States and our infrastructure is primarily hosted there. If you are in the European Economic Area, the United Kingdom or Switzerland, your information may be transferred to and processed in the United States and in other countries where our service providers operate.

Where we make such a transfer we put an approved safeguard in place — normally the European Commission’s Standard Contractual Clauses, together with the UK Addendum where the UK GDPR applies — and we assess whether additional measures are needed for the destination country.


How long we keep it

A merchant can ask us to delete specific records sooner, and we act on that instruction unless we are legally required to keep them.


Automated processing

Some parts of the platform process information automatically. Where personal information is involved, the following limits apply.

  • Automated processing operates on a merchant’s own data and produces output for that merchant only.
  • We do not use one merchant’s data to train models that serve another merchant.
  • We do not make decisions about you based solely on automated processing that produce legal effects or similarly significant effects on you.

How we protect information

We encrypt data in transit, restrict access to the people who need it for their role, separate merchant accounts from one another so that one cannot reach another’s data, log administrative access, and review our arrangements as the platform changes.

No system is perfectly secure and we do not claim otherwise. If a breach affects your information and the law requires us to tell you, we will, without undue delay.


Cookies and similar technologies

Our website uses cookies and similar technologies that are necessary for it to work and to keep it secure, and — where you agree — a small amount of analytics so we can tell which pages are useful.

You can refuse non-essential cookies without losing access to anything on the site, and you can clear or block cookies in your browser at any time. Blocking strictly necessary cookies may stop parts of the site working.

Merchants decide independently what runs on their own storefronts. Cookies you meet on a merchant’s store are covered by that merchant’s policy.


Your rights

Depending on where you live, you may have the right to ask us to give you a copy of your information, correct it, delete it, restrict or object to how we use it, provide it in a portable form, or withdraw consent you previously gave. Where we rely on legitimate interests, you may object and we will stop unless we have compelling grounds not to.

To exercise any of these for information we control, email [email protected]. We will respond within 30 days, and will tell you if we need longer and why. We may need to verify your identity first.

For information held inside a merchant’s account, contact that merchant. They control it, and we will support them in answering you.

We will not treat you differently, or give you a worse service, because you exercised a privacy right. If you are in the EEA or the UK you also have the right to complain to your local supervisory authority.


United States state privacy rights

If you live in a US state with a comprehensive privacy law — including California, Virginia, Colorado, Connecticut, Utah and Texas — you have rights to know what personal information we collect and why, to access and delete it, to correct it, to receive a portable copy, and to appeal a decision we make about your request.

We do not sell personal information and we do not share it for cross-context behavioral advertising, as those terms are defined in the California Consumer Privacy Act. We do not use or disclose sensitive personal information beyond what is necessary to provide the service.

To make a request, or to appeal one we have refused, email [email protected]. An authorized agent may act for you if they provide proof that you gave them permission.


Children

Netz is a business tool and is not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us information, email [email protected] and we will delete it.


Changes to this policy

We update this policy as the product and the law change. The date at the top always reflects the current version. Where a change materially affects how we use your information, we will tell affected users directly rather than relying on you to notice.
